These Terms and Conditions govern your access to bitsaccurate.in and any software development services provided by BitsAccurate. BitsAccurate is a registered business under UDYAM Registration Number UDYAM-BR-35-0051251, registered in Bihar, India in March 2026. We operate from Delhi, India and serve clients across India and the Middle East. By visiting our website or engaging our services, you confirm that you have read, understood, and agree to be bound by these Terms. These Terms are entered into under the Indian Contract Act 1872, the Information Technology Act 2000, and all other applicable laws of India.

BitsAccurate provides custom software development services including: — Flutter mobile application development for iOS and Android — Backend REST API development using PHP, Laravel, Node.js, and Firebase — Web application and website development using React, Next.js, and TypeScript — App Store and Google Play Store submission, deployment, and management — App and API maintenance, bug fixing, performance improvement, and feature development — Technical consultation related to the above services The specific scope, deliverables, timeline, and pricing for any project are defined in a written Project Proposal. BitsAccurate reserves the right to decline any project enquiry at our sole discretion without providing a reason.

All engagements begin with a written Project Proposal containing: scope of work, deliverables, timeline, fixed total price, and payment schedule. An engagement is confirmed when: (a) the client accepts the Proposal in writing via email or messaging AND (b) the agreed advance payment is received. Development does not begin before advance payment is received. Any changes to the agreed scope after confirmation must be agreed in writing before implementation. Scope changes may affect the timeline and total price. Verbal agreements on scope changes are not binding.

All projects are quoted at a fixed total price agreed in the Project Proposal. We do not bill hourly. The full cost is disclosed before development begins. Indicative pricing tiers (subject to project-specific variation): — MVP applications: from USD $300 — Standard applications with backend: from USD $1,000 — Enterprise applications with complex features: from USD $3,000 Final pricing is always stated in the Project Proposal. PAYMENT SCHEDULE Typically 50% advance before development begins and 50% upon delivery. For larger projects, a milestone payment schedule is defined in the Proposal. INVOICING All invoices are issued digitally via email. Accepted methods include international and domestic bank transfer, UPI (for Indian clients), and any other methods agreed in writing. LATE PAYMENT Late payment may result in suspension of development until payment is received. BitsAccurate is not liable for timeline delays caused by the client's failure to pay on time. NON-REFUNDABLE WORK Fees paid for work already performed and delivered are non-refundable. If a client cancels after work has begun, they will be invoiced for all work completed to the date of cancellation.

UPON FULL PAYMENT Upon receipt of full and final payment, the client owns all custom source code, design assets, and application-specific content created specifically for their project. BitsAccurate retains no rights over such deliverables after full payment. BITSACCURATE RETAINED RIGHTS BitsAccurate retains ownership of: general-purpose code libraries and utilities not created exclusively for the client; our internal frameworks and methodologies; and open-source components (which remain under their respective licences). THIRD-PARTY LICENCES The client is responsible for obtaining licences for third-party services required for their project (Apple Developer Program, Google Play account, API subscriptions, hosting). BitsAccurate will advise but is not responsible for third-party subscription costs. PORTFOLIO RIGHTS BitsAccurate may reference completed projects in our portfolio and marketing. If a client requires confidentiality, this must be requested in writing before the project begins.

Where deployment to the Apple App Store or Google Play Store is in scope: CLIENT RESPONSIBILITIES The client must: maintain their own Apple Developer account ($99/year, payable to Apple) and Google Play Developer account ($25 one-time, payable to Google); provide BitsAccurate with necessary access to submit on their behalf; ensure app content complies with Apple and Google guidelines; and respond promptly to review questions requiring client-specific information. BITSACCURATE RESPONSIBILITIES BitsAccurate will: prepare all submission materials; manage the review process; handle first-level rejection responses; and communicate all review outcomes. DISCLAIMER App store approval is at the sole discretion of Apple and Google. BitsAccurate makes no guarantee of approval on any specific timeline. We are not liable for rejection caused by platform policy changes, client-provided content that violates guidelines, or any factors outside our reasonable control.

WARRANTY PERIOD BitsAccurate provides a 30-day warranty following final delivery. During this period, we will correct bugs in the delivered software attributable to our development work at no additional charge. WARRANTY EXCLUSIONS The warranty does not cover: modifications made by the client or third parties after delivery; issues from third-party service changes after delivery; new features not in the original scope; or issues caused by the client's hosting environment. ONGOING SUPPORT Beyond the 30-day warranty, continued support is available under a separate maintenance agreement. NO GUARANTEE OF PERFECTION We strive to deliver high-quality software that meets the agreed specifications. We do not guarantee the software will be entirely free of defects under all conditions or will meet requirements not specified in the agreed scope.

By engaging BitsAccurate, the client agrees to: — Provide timely feedback, approvals, content, and materials. Delays caused by the client may result in corresponding timeline adjustments. — Ensure all content, branding, and materials provided to BitsAccurate do not infringe the intellectual property or other legal rights of any third party. — Maintain their own secure backups of all project files and materials. — Obtain and pay for all necessary third-party licences and accounts. — Communicate honestly and in good faith throughout the engagement.

To the maximum extent permitted by applicable law, BitsAccurate's total aggregate liability for any project engagement shall not exceed the total amount actually paid by the client for that specific project. BitsAccurate shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, business, or data. We are not liable for delays or failures caused by circumstances beyond our reasonable control including: natural events, internet outages, third-party service disruptions, or government actions. Nothing in these Terms limits liability for death, personal injury caused by negligence, fraud, or any liability that cannot be lawfully excluded under Indian law.

Both parties agree to treat as strictly confidential all proprietary information shared during the engagement — including business strategies, technical specifications, source code, client data, and financial information. Neither party shall disclose the other's confidential information to any third party without prior written consent. This obligation remains in effect for two (2) years following the conclusion of any engagement.

Either party may terminate a project engagement by written notice via email. Upon termination: — The client will be invoiced for all work completed to the termination date, calculated proportionally against the agreed milestone schedule. — Advance payment for milestones not yet commenced will be refunded within 14 business days after deducting the value of work already performed. — BitsAccurate will deliver all completed deliverables within 7 business days. — All confidentiality obligations continue after termination. BitsAccurate may terminate immediately if the client engages in abusive behaviour, fails to pay after 14 days written notice, or materially breaches these Terms.

BitsAccurate operates as a fully remote software development studio. All communication takes place through email (info@bitsaccurate.in) and WhatsApp. Business hours: Monday to Saturday, 10:00 AM to 7:00 PM IST (UTC+5:30). We aim to respond to all messages within 24 hours during business hours. We do not maintain a physical office. Our registered address is for official correspondence only.

These Terms are governed by and construed in accordance with the laws of the Republic of India. In the event of any dispute, both parties agree to first attempt resolution through good-faith negotiation for 30 days from written notice. If unresolved, the dispute shall be subject to the exclusive jurisdiction of the courts in Delhi, India. Nothing in this section prevents either party from seeking urgent interim relief from a court to prevent irreparable harm.

BitsAccurate may update these Terms at any time. Updated Terms will be posted on this page with a revised Last Updated date. Continued use of our website or services after posting of updated Terms constitutes acceptance.
